Terms of service
The agreement between you and AutoIFC: accounts, credits and payment, your scans and models, acceptable use, what we promise and what we do not, and how either side can end it.
These Terms of Service ("Terms") govern your access to and use of AutoIFC, the scan-to-BIM service at autoifc.com and app.autoifc.com (the "Service"), operated by Lidarvisor LLC, a New Mexico limited liability company ("AutoIFC", "we", "us" or "our").
By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company or another organisation, you agree to these Terms on its behalf and confirm that you may do so.
1. Definitions
- "Account": your registered user account on the Service.
- "Scan": a terrestrial point cloud you upload (E57, LAS, LAZ or PLY).
- "Run": one execution of the modelling pipeline on a Scan, producing a proposed model.
- "Deliverables": the IFC files (proposed and reviewed), the PDF report and the evidence images a Run produces.
- "Customer Data": your Scans, your Deliverables, your review actions and everything else you put into the Service.
- "Credits": the prepaid unit of the Service. One Credit corresponds to one square metre of facade modelled.
- "Credit Pack": a one-time purchase of Credits at the prices shown on the pricing page.
2. Your account
2.1 Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Service.
2.2 Security
You are responsible for keeping your password and your API keys confidential and for everything done under your Account. Tell us at once at contact@lidarvisor.com if you suspect unauthorised access.
2.3 Accurate information
You agree to give accurate and current information when you register and to keep it up to date.
3. Credits
3.1 Pay as you go
The Service has no subscription, no seats and no minimum. You buy Credit Packs when you need them and spend Credits when you export a Run. Prices, pack sizes and the rate per square metre are those published on the pricing page at the time of purchase.
3.2 Welcome Credits
An Account may receive a one-time allocation of welcome Credits. Where it does, the balance is shown on the credits page, they are spent like bought Credits, they are not renewed, and we may change or withdraw the allocation for new Accounts at any time.
3.3 When Credits are charged
Uploading a Scan, launching a Run, viewing and reviewing its result in the viewer cost nothing. Credits are charged once per Run, at the first download of that Run's IFC or report, for the facade area the Run actually modelled, rounded up to the next square metre. Every later download of the same Run, in either variant, is free. A Run that fails, is cancelled or is never exported is never charged. Deliveries made through the API or by webhook count as a download.
3.4 Estimate before you launch
When a Scan is uploaded the Service measures the facade it will model and shows the estimated area, and therefore the estimated Credits, before you launch. The estimate is made from the returns of the Scan itself and is our best measurement, not a quotation: the charge is the area the Run modelled. If the Run models more than the estimate, you can decide not to export it, and nothing is charged.
3.5 No expiry, no cash value
Credits do not expire while your Account exists. They are not transferable between Accounts, cannot be redeemed for cash, and are not refunded, except as stated in section 4.5.
3.6 Ledger
Every Credit movement (granted, bought, charged, refunded) is a line in the ledger of your Account, visible on your credits page. The ledger is the record of what you were charged.
4. Payment terms
4.1 Pricing
Current prices are published at autoifc.com/pricing, in US dollars. During the launch phase the price is set low so that you can measure what the Service is worth on your own buildings; we may raise it with notice, and Credits already bought keep their value in square metres.
4.2 Billing
Credit Packs are charged at the time of purchase, by card, through our payment provider Stripe. The checkout and the receipt are issued by Lidarvisor, the operating company. Invoicing terms are available for the largest pack on request.
4.3 Taxes
Prices exclude applicable taxes. You are responsible for the taxes that apply to your purchases, except taxes on our net income.
4.4 Failed payments
A Credit Pack is credited to your Account when the payment succeeds. If a payment fails or is reversed after Credits were granted, we may remove the corresponding Credits and suspend downloads until the balance is settled.
4.5 Refunds
Credit Packs are not refundable once purchased. If a Run was charged and its Deliverables could not be produced or downloaded because of a defect of the Service, contact us and we will refund the Credits of that Run to your ledger. Where the law of your country gives you a right of withdrawal that cannot be waived, that right applies.
5. Your Scans, your models
5.1 Ownership
You keep every right in your Customer Data. The IFC models and reports produced from your Scans are yours. By uploading a Scan you grant us a limited licence to store, process, transform, transmit to our model provider and display it, solely to provide the Service to you and to the people you share a project with.
5.2 Your responsibility for the Scan
You confirm that you have the right to upload each Scan and to have a model produced from it, including any right of the building's owner or of the surveyor who captured it, and that the Scan does not contain data you are not allowed to process.
5.3 The proposed model is an aid to your review
A Run produces a proposal: the walls, openings and details the engine read in the Scan, each with its evidence. The Service gives you the tools to accept, reject, edit and score every element. The reviewed model is your work, prepared under your professional judgement; the proposal is not a survey, a certification or professional advice, and you remain responsible for verifying the model before you rely on it or deliver it to anyone.
5.4 No training on your data
We do not use your Scans, the images derived from them or your models to train models, and our model provider processes them under terms that exclude training. We do measure the Service on the results of real Runs, in aggregate, to improve it.
5.5 Retention and export
Your Customer Data is kept while the project exists. You can download your Scan, your Deliverables and your evidence images from the project at any time, and you can delete a project at any time, which deletes its files. On erasure of your Account, every project it owned is deleted. Details are in the privacy policy.
5.6 Sharing
Share links you create let their holders view the model of a project in the viewer, with the restrictions you set (password, expiry, classes shown). You are responsible for whom you give a link to, and you can revoke a link at any time.
6. Acceptable use
You agree not to:
- use the Service for an unlawful purpose, or upload a Scan you have no right to process
- upload malicious code, or probe, scan or attempt to compromise the Service
- reverse engineer, decompile or extract the engine, its prompts or its knowledge base
- resell, sublicense or offer the Service to third parties as your own, except as agreed in writing
- access the Service by automated means other than the published API and your own API keys, or share a key with a third party
- interfere with the Service or use it in a way that degrades it for other users
We may suspend or terminate an Account that breaks these rules.
7. The Service
7.1 What it does today
AutoIFC models building facades from terrestrial scans: walls, windows, doors, vents, railings, terraces and their plinths, as IFC elements with evidence, at the levels of detail and tolerances offered in the app; a review workspace, a 3D viewer, share links, a PDF report, a REST API and webhooks. Interiors, roofs and terrain are not modelled in this version. Accuracy figures published on this site describe measured Runs on reference buildings and are not a warranty for yours.
7.2 Changes
We improve the Service continuously and may add, change or withdraw features. We will give reasonable notice of a change that materially reduces what a Credit buys.
7.3 The model provider
The drawing step of a Run calls a third-party model API. Its availability, and therefore the duration of a Run, may vary; a Run that cannot complete is marked failed and is not charged.
8. Intellectual property
8.1 Ours
The Service, its software, engine, prompts, knowledge base, interface, documentation and trademarks belong to Lidarvisor LLC and are protected by intellectual property law. These Terms grant you no right in them beyond the licence to use the Service.
8.2 Feedback
If you send us suggestions or feedback, you grant us a perpetual, royalty-free licence to use them without obligation to you.
9. Disclaimers
9.1 "As is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
9.2 No guarantee of results
We do not guarantee that a Run will find every element of a facade, that the model will meet a given tolerance, or that the Deliverables will be suitable for a particular use, permit, contract or standard. You are responsible for reviewing and verifying every model before you rely on it.
9.3 Availability
We aim for high availability but do not guarantee uninterrupted access. The Service may be unavailable during maintenance, updates or events beyond our control.
10. Limitation of liability
10.1 Exclusion of damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIDARVISOR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY MODEL IT PRODUCED.
10.2 Cap
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
10.3 Basis of the bargain
THESE LIMITS REFLECT THE ALLOCATION OF RISK BETWEEN US AND ARE AN ESSENTIAL BASIS OF THIS AGREEMENT. Some jurisdictions do not allow certain limitations; in those, our liability is limited to the extent the law permits.
11. Indemnification
You agree to indemnify and hold harmless Lidarvisor LLC and its officers, employees and agents from claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, your Customer Data, a model you delivered to a third party, your breach of these Terms, or your violation of a third party's rights.
12. Term and termination
12.1 Term
These Terms apply for as long as you have an Account or use the Service.
12.2 By you
You may stop using the Service at any time; there is no subscription to cancel. To erase your Account and its projects, write to contact@lidarvisor.com from the Account's address. Download what you need first: erasure deletes your Scans and Deliverables and cannot be undone, and unused Credits are forfeited.
12.3 By us
We may suspend or terminate your Account if you breach these Terms, if the law requires it, or if continuing to provide the Service is no longer commercially reasonable. We give notice before termination unless immediate action is needed to protect the Service or other users, and, where the termination is not for breach, at least 45 days to download your Deliverables before they are deleted.
12.4 Survival
Sections 5.1, 8, 9, 10, 11 and 14 survive the end of these Terms.
13. Changes to these Terms
We may update these Terms. For a material change we will notify you by email or with a notice in the app at least 30 days before it takes effect. Continued use after that date is acceptance of the new Terms; if you do not agree, stop using the Service and ask us to erase your Account.
14. General provisions
14.1 Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict of law rules. If you are a consumer in the European Union, you also keep the protection of the mandatory rules of the country where you live.
14.2 Disputes
Any dispute arising from these Terms or the Service is resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Albuquerque, New Mexico, or remotely by agreement. Each party bears its own costs and the arbitrator's fees are split equally. You agree to resolve disputes individually and waive any right to take part in a class action or class arbitration. Either party may bring a qualifying individual claim in small claims court.
14.3 Entire agreement
These Terms and the privacy policy are the entire agreement between you and us about the Service and replace any earlier agreement.
14.4 Severability and waiver
If a provision is held unenforceable it is modified to the minimum extent needed and the rest stays in force. Not enforcing a provision is not a waiver of it.
14.5 Assignment
You may not assign these Terms without our written consent. We may assign them, for instance to a successor of the business, without restriction.

15. Separate agreements
If you have signed a separate agreement with Lidarvisor LLC for AutoIFC, for instance for invoicing terms, resale or an integration, that agreement prevails over these Terms where the two conflict.
By using AutoIFC you acknowledge that you have read, understood and agree to these Terms of Service.
